Regulation of the services provided by Start Click® through the Website and its Lawyers.
GENERAL
These Terms and Conditions, drafted on March 25, 2021, govern the general terms and conditions relating to the access to and use by the User of our website https://www.startclick.cl, as well as any type of information, content, image, video, audio, and any other material transmitted through this means.
Likewise, these Terms and Conditions regulate and apply to the use of and access to the services provided through this website and/or advertised on the Start Click® website: www.startclick.cl.
For the purposes of these Terms and Conditions, “Website” shall mean the external appearance of the screen interfaces, both static and dynamic, that is, the navigation tree, and all integrated elements, both in the screen interfaces and in the navigation tree (hereinafter, the “Content”), and all those online services or resources offered to Users (hereinafter, the “Services”).
Through these Terms and Conditions, Start Click® reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and of the Content and Services incorporated therein.
The User’s consent to these Terms and Conditions implies acknowledgment and acceptance that Start Click®, at any time, may interrupt, deactivate, and/or cancel any of the elements integrated into the Website or access thereto.
Access to and use of the Website and related or attached Content described in this document shall be governed entirely by Chilean law.
As a consequence, visits, as well as any contracts and transactions that the User may carry out on our platform, together with their legal effects, shall be subject to the laws and jurisdiction of the Courts of Chile.
Particularly relevant for these purposes are Law No. 19,628 on Personal Data Protection and Law No. 19,496 on Consumer Rights.
In addition to these Terms and Conditions, the Website includes a Privacy Policy describing how the User’s personal information and data are processed when visiting our Website.

By entering our Website, the User declares to be aware of the Privacy Policy.
Therefore, Users are advised to read these Terms and Conditions carefully, print them, and keep a copy for their convenience, reference, and security.
THE USER
In accordance with these Terms and Conditions, access to this Website, browsing and use thereof, as well as any spaces enabled for interaction among Users or between the User and the Website, such as comment sections, blogging spaces, forums, and similar extensions, confer upon individuals the status of “User”.
Accordingly, these Terms and Conditions shall be deemed accepted from the moment Users access our Website or its Content.
Therefore, it is likewise understood that the User accepts any future modifications that may be made to these Terms and Conditions, without prejudice to any Chilean laws that may in the future regulate this kind of document or that may apply to the use of websites.
Access to the Website by the User is free of charge, except with respect to paid content, such as the legal services offered and any other product or service requiring prior payment for access. In such cases, the User may be referred to as “Client”.
Access to and payment for services offered through the Website shall also be subject to and governed by these Terms and Conditions from the moment the User or Client accepts the estimates for the required services and/or pays for such services, whether or not with access to a user account through or on the Website.
I.- USER REGISTRATION
Acceptance of these Terms and Conditions at the time of registration by the User shall be a requirement for the use of paid content on this Website, as well as for carrying out transactions and acquiring products or services through this portal. In addition, the User must designate an access password for their personal account and safeguard it with due diligence, as indicated in these Terms and Conditions.
These Terms and Conditions shall be deemed known and accepted by the mere fact of the User’s registration, an act that shall include an express statement by the User acknowledging knowledge thereof.
Each User’s registration shall be verified by completing and submitting the form provided for this purpose by the Website in each case, which shall be deemed completed when the User clicks on the corresponding element within the Website.
II.- Password
Once the User is registered, they shall have a username and password to access the Website and the subscribed paid content. The User may change their password through a procedure regulated within the Website. Likewise, the User shall have personalized, confidential, and secure access.
It is the User’s responsibility to safeguard and keep their password confidential, change it periodically, and not provide their access credentials to any other person.

Start Click® provides the User with a service characterized by the diversity of the content made available. The User assumes responsibility when entering the Website and undertakes to make proper use of it and of its contents.

Such use must also not contravene Chilean law, morality, or public order, nor in any way infringe third-party rights or the normal operation and functioning of the Website.
The truthfulness and lawfulness of the data and information provided by the User in the registration forms available on the Website. In any case, by accepting these Terms and Conditions, the User undertakes to notify Start Click® immediately of any event related to the misuse of information registered in such forms. By way of example, this includes theft, loss, unauthorized access to accounts, password changes not made by the User, and any other similar event, so that we may proceed to its immediate cancellation.
Reservation of the right to remove comments and interactions
Through these Terms and Conditions, Start Click® reserves the right to remove all comments and interactions from Users that violate the law, respect, or dignity of the person, or that are discriminatory on the basis of race, nationality, sex, political or sexual orientation, lineage, or condition.
Likewise, the Website reserves the right to remove comments and interactions of a pornographic nature, or constituting messages known as “spam”, or that threaten youth or childhood, public order or safety, or that, in the opinion of Start Click®, are not appropriate for the Website.
Disclaimer regarding Users’ opinions
Likewise, through these Terms and Conditions, Start Click® or the Website shall not be responsible for opinions expressed by Users of any kind through comments, tools, extensions, blogs, forums, and any other space for exchange among persons on this Website.
Mere access to https://www.startclick.cl does not imply any commercial relationship between Start Click® and the User.
IV.- Legal capacity
The User declares to be of legal age and therefore to have the legal capacity necessary and sufficient to be bound by these Terms and Conditions. Consequently, Start Click® is not directed at minors and declines any responsibility for non-compliance with this requirement.
Even so, the rules governing legal capacity established under Chilean law shall apply in all cases where relevant.
Therefore, if a person lacks legal capacity to contract, they must refrain from using the Content and Services requiring such capacity.
Start Click® or the Website may, at any time, temporarily or permanently suspend the participation of users who are shown to lack the legal capacity to use and/or access the Services and Content requiring it, or who provide false, inaccurate, or fraudulent information to the Website.
The Start Click® Website is primarily directed at Users residing in Chile. Consequently, Start Click® does not guarantee that the Website complies, in whole or in part, with the laws of other countries.
If the User resides or is domiciled in a foreign country and decides to access and browse this Website, they shall do so at their own responsibility, ensuring that such access and browsing comply with the laws of their country of residence or domicile, or of the country from which they access the Content and Services of this Website. For these purposes, Start Click® assumes no liability arising from such access.
V.- Rights and guarantees of the Website User
These Terms and Conditions establish that the User shall enjoy all rights recognized by consumer protection legislation in force in Chile.
Likewise, the User shall enjoy all rights conferred by these Terms and Conditions.
In addition, the User shall at all times have the rights of information, rectification, and cancellation of personal data, in accordance with Law No. 19,628 on Data Protection.
PAYMENT METHODS
The products and services offered on this Website may be paid for using the methods enabled in each case to access the product or service, whether transactions or services are carried out online or in person.
If the User needs to pay for a product or service by bank transfer, they must request Start Click®’s account details through any of the communication channels available on the Website or on our social media.
If payment platforms or gateways are used, the User declares that they understand these are owned by third parties or payment service providers or banking transfer providers, which are independent and not affiliated with Start Click® or the Website.
Accordingly, the continuity of the services over time, as well as their proper functioning, are the sole responsibility of these providers and in no case of Start Click®.
DELIVERY AND SHIPPING
The products or services purchased through the Website will be subject to the delivery and shipping conditions selected by the User at the time of purchase or contracting the service, from among those available in each case or for each type of product or service.
Provision of services:
Shipping and delivery
Due to their nature, services do not involve shipping or delivery, except with respect to the sending of documentation, contracts, or court resolutions.
In such cases, this will depend on the nature of the service and the contracted obligations, and Start Click® or the Website will determine whether physical delivery is necessary and the means of shipment. This will be duly informed to the User at the time of contracting the services, including any additional shipping costs.
Shipping and delivery of physical products:
Shipping
Regardless of the shipping method selected by the User, orders will be dispatched on the same day provided they are completed before 11:00 AM. Orders completed after 11:00 AM will be dispatched on the next business day. Orders completed on Fridays will be dispatched on the following business Monday. Saturdays are not considered business days for these purposes.
Deliveries
Depending on the shipping method selected by the User, the following conditions apply:
- Chilexpress home delivery
Once dispatched, the delivery times of Chilexpress will apply:
- Priority: next business day delivery
- Express: delivery on the following business day
- Extended: delivery during the week
Priority, Express, or Extended shipping is automatically selected in the shopping cart based on the User’s address, as not all services are available in all areas, which depends entirely on Chilexpress conditions.
Delivery times may vary due to force majeure events such as protests, pandemics, earthquakes, or high shipment volumes, all of which are beyond the control and responsibility of the Start Click® Website.
- Chilexpress collect on delivery
In this case, deliveries are fully subject to Chilexpress branch pickup conditions. It is the User’s responsibility to verify the existence of a Chilexpress office at their location. The recipient has 5 business days to collect the shipment. After that period, the shipment will be returned to the sender.
The User is also responsible for verifying shipping costs before completing a purchase. Start Click® is not responsible for branch pickup fees selected by the User.
User or Client address
The accuracy of the delivery address is the sole responsibility of the User.
Start Click® or the Website is not responsible for lost products due to errors or omissions in the delivery address provided by the Client.
Products returned due to such errors release Start Click® from any obligation to resend them, unless the Client requests it and pays for a new shipment or requests a new collect-on-delivery shipment at their own risk.
Additionally, errors or omissions in the address release Start Click® from any liability for loss, damage, or delays in delivery.
EXCHANGES AND RETURNS
This section regulates all scenarios related to the sale of physical products offered by Start Click® through the Website. The User is responsible for reading these conditions carefully before purchasing.
If a product does not meet the User’s expectations, they may request an exchange or return under the following conditions:
- The User has 3 days from receipt to request an exchange or return.
- The User must send the product back at their own cost once Start Click® approves the request in writing.
The product must be unused, with all accessories and original packaging. Proof of purchase (receipt, invoice, shipping document, or similar) must be provided.
This warranty does not apply to custom-made or made-to-order products.
For used, open-box, second-quality, or defective products, Start Click® will inform the User of their condition. If the User purchases them knowingly at a reduced price, exchanges or returns will not apply.
Refunds
Refunds will be issued through the same payment method used by the User within 48 hours after approval, once the product has been returned and proof of purchase has been verified.
LEGAL SERVICES
These Terms and Conditions apply to legal services offered through the Website or social media channels, like fb.com/startclickchile or instagram.com/startclickchile.
Contracting
Legal services are considered contracted upon acceptance of a service quote by the User, through any means (user account, email, or written communication). Upon acceptance, the User becomes a “Client”.
The User acknowledges that accepted quotes are binding and require payment of the indicated fees and procedural costs.
Payment and provision of services
Legal services will only be provided once payment has been made through the available methods communicated to the User.
If payment is not made within the deadline indicated in the quote, invoice, or email, the User will be deemed to have declined the service. This also applies to staged or deferred payments.
Disclaimer
In case of technical failures affecting communication of documents or information (e.g., platform failures, internet issues), the User must notify the Website so measures can be taken.
Such failures do not entitle the User to refunds.
Refunds
No refunds will be issued once legal services have commenced, even if the Client decides not to continue.
Warranty
The Website’s lawyers do not guarantee successful outcomes. However, they guarantee:
a) Adequate knowledge, personnel, and resources
b) Timely and diligent execution
c) Compliance with agreed terms and suitability for intended purposes
If services do not meet these standards, corrective actions must be taken within a reasonable time, and in any case within 2 business days after written notice.
Breach
If the lawyers fail to meet their obligations, the Client may terminate the contract without compensation.
If the Client fails to pay within 15 business days, the Website or lawyers may terminate the contract without obligation to continue services.
Confidentiality
All client information is confidential and will not be disclosed without prior written consent.
Upon termination or upon request, all confidential information must be returned.
Confidentiality does not apply if:
- The information was already known
- It is public
- It was received from a third party without confidentiality obligations
- Disclosure is required by law or authority
No employment relationship
Lawyers determine their own working time and are not subject to schedules.
Term
These Terms remain in force from acceptance and indefinitely thereafter, unless terminated by either party with 60 days’ prior written notice.
Dispute resolution
The parties submit to the jurisdiction of the courts of Santiago, Chile.
INTELLECTUAL PROPERTY AND RESERVED RIGHTS
All rights related to this Website, including intellectual property over the website itself, its pages, course content, and any other type of content, are the exclusive property of Start Click® or the Website.
By way of example, such content includes all types of texts, graphic or audiovisual material, including images, audio or video clips, logos, trademarks, icons of any kind, downloadable material or content sent by email, data and information compilations, and the website’s source code.
Likewise, all or part of the content mentioned above is registered as trademarks and/or is protected by the corresponding intellectual property rights.
Therefore, these rights are the exclusive property of Start Click®, and any improper use or reproduction for commercial purposes is prohibited without prior written authorization from the rights holder. Any use that may damage or negatively affect Start Click® is also prohibited.
Start Click® trademarks are registered with the National Institute of Industrial Property (INAPI) under registration number 1336176, year 2021.
Any other trademarks present on this Website that are not owned by Start Click® belong to their respective owners.
Without prejudice to the consents that the User or Client must provide in each case, the general provisions set forth in the Privacy Policy are deemed to be incorporated into these Terms and Conditions.
IMAGE RIGHTS
Users who access the Website and participate by posting comments on the blog, forum, or any other publicly accessible platform, thereby accepting these Terms and Conditions, give their consent for their profile photographs or avatars to be publicly displayed to visitors or new users of the Website. In no case shall such photographs or avatars harm the honor or reputation of the individual.
If the User or Client does not consent to the use of a photograph or avatar in which their image appears, they may contact us through the contact form on our Website to formally request in writing the removal of such material from the Website or any of our social media platforms, providing the link or a screenshot of the image in question.
The above shall not apply to photographs, avatars, or videos shared in closed or private groups, closed forums, or any other communication platforms not open to the general public in which the User or Client participates.
LIABILITY
The Website or Start Click® shall not be liable, under any circumstances, for the following:
a) Improper use by Users, Clients, or visitors of the Website of the stored content, or of the products or services acquired therein, as well as of the industrial or intellectual property rights contained on the Website or in such products or services.
b) Damages, whether actual or potential, caused to Users, Clients, or visitors arising from the operation of the Website’s search tools or from errors generated by technical elements of the Website or its search engine.
c) Content of external websites that Users may access with or without authorization from Start Click® or the Website.
d) Access by individuals who do not meet the required legal age for using the Website, in accordance with these Terms and Conditions and applicable Chilean law.
e) Loss, misuse, or unauthorized use of passwords, validation codes, or similar credentials, whether by the User or a third party, as described in these Terms and Conditions. Likewise, the parties acknowledge that the technical and IT support provided by www.indivarus.cl is not infallible, and circumstances beyond the control of Start Click® or the Website may occur, causing temporary unavailability of the Website or its platform.
f) Information regarding Start Click®, the Website, or its lawyers that is found on external websites not belonging to https://www.startclick.cl.
In the event any of the above occurs, Start Click® or the Website will take all reasonable measures within its capacity to restore proper functioning as soon as possible, without incurring liability.
The Website or Start Click® does not guarantee uninterrupted availability or continuous operation of the Website, nor continuous access to its content or offers.
The Website or Start Click® is not responsible for the presence of viruses or other harmful elements in files or systems belonging to Users.
The Website or Start Click® shall not be liable for damages caused by improper use of the technologies and platforms made available to Users.
Likewise, it shall not be liable for damages resulting from misuse or bad faith use by Users of the Website.
In the event of duplicate payment, Start Click® or the Website will refund the excess amount within 7 business days from receipt of the corresponding claim, which must include proof of payment.
When registering, accessing accounts, making transfers, or communicating with the Website, SSL security certificates are used to encrypt information. The Website or Start Click® does not store or retain Users’ or Clients’ financial data.
ELECTRONIC DOCUMENTS
In accordance with Exempt Resolution No. 11, dated February 14, 2003, issued by the Chilean Internal Revenue Service, which establishes the procedure for authorized taxpayers to issue electronic documents, such documents may be sent electronically to recipients.
Accordingly, recipients of such electronic documents declare and accept that, by approving these Terms and Conditions as Users of the Website, they authorize the Website or Start Click®, represented by Renata Quintana, to deliver the tax document corresponding to the purchase of a product or the contracting of a service exclusively by electronic means.
Users also authorize that notifications regarding the issuance of such tax documents be sent by email.
In compliance with the aforementioned regulations, if the User needs to maintain accounting records, they assume the following obligations:
a) Print electronically received documents for each tax period immediately upon receipt.
b) Print documents in their original size and format.
c) Use white paper sized 21.5 cm x 14 cm (half letter) or up to 21.5 cm x 33 cm (legal size).
d) Ensure print quality allows legibility for at least 6 years, in accordance with applicable law.
DATA SECURITY POLICY
The Website or Start Click® will adopt all necessary measures to protect Users’ data and passwords, including encryption systems, security certificates, and other equivalent measures deemed appropriate.
If changes are made to User information or irregularities are detected (e.g., suspicious transactions or identity verification issues), the Website may contact the User by phone or email to verify the information and prevent fraud.
If no contact is established within 47 hours, any purchase or service request will not be confirmed.
The User will be notified by phone or email if the transaction is canceled due to inability to verify identity or payment method.
Records of attempts to contact the User will be available for 15 days, should the User wish to confirm the transaction.
Users are fully responsible for loss, misuse, or unauthorized use of purchased products or services after completion of a transaction.
PERSONAL DATA
By accessing the Website, Users, Clients, or visitors guarantee that the information provided is truthful, complete, accurate, and up to date.
In accordance with Law No. 19.628 on Personal Data Protection, such data will be stored in a database owned by the Website or Start Click® and used exclusively for purposes such as communication, validation of transactions, delivery of products or services, issuance of invoices or receipts, and responding to inquiries.
Such data will not be shared with third parties without the User’s express authorization, nor will it be transferred internationally.
The Website or Start Click® will never request personal or financial data via email.
The Website assumes that data provided by Users or authorized persons is accurate.
By accepting these Terms and Conditions, Users also consent to the use of their personal data for sending offers that may differ from those available on the Website.
Notwithstanding the above, the Website guarantees Users the full exercise of their rights under Law No. 19.628, including access, modification, deletion, and blocking of personal data.
Requests related to these rights will be addressed within a maximum of two calendar days.

POLÍTICA DE SEGURIDAD DE DATOS
El Sitio Web o Start Click® adoptará todas las medidas necesarias para resguardar los datos de sus Usuarios y clave secreta, como sistemas de encriptado de información, certificados de seguridad y otros semejantes o equivalente que el Sitio Web considere prudentes para estos efectos.

Consultas adicionales pueden realizarse por cualquiera de los canales de comunicación habilitados en el Sitio Web, presente en este mismo documento de Términos y Condiciones.
Con todo lo anterior, los Usuarios son plenamente responsables por el extravío o pérdida, mal uso o uso no autorizado que se diera del producto o servicio adquirido o contratado, sea que incurran ellos o terceros en los hechos descritos previamente, luego de realizada una compra o contratación de servicio, siguiendo la forma establecida en los presentes Términos y Condiciones.
DATOS PERSONALES
Al acceder al Sitio Web, los Usuarios, los Clientes o los visitantes garantizan que la información que proporcionan para ingresar o para la compra de productos o contratación de servicios es veraz, completa, exacta y actualizada.
